Terms of service - BioTakeAway

All orders placed with BioTakeAway (phone, mail and e-mail) constitute the acknowledgment and acceptance of all conditions and terms listed under BioTakeAway Terms and Conditions, and all conditions listed below. All parts shall remain the property of BioTakeAway until paid for in full. All prices, materials, design, and specifications are subject to change without notice. It is the customer's responsibility to retain any and all invoices for their record. All sales are final by BioTakeAway (seller) to said account (Buyer). Buyer understands that all goods sold by Seller are in "as-is" condition. Seller does not have any control of what consistency said manufacturers have in production of said good. If we encounter difficulties locating the buyer (via phone, fax, mail, and e-mail), we will backorder the item until it arrives or cancel the order of that item if it is no longer available. Only individuals over 18 years of age may order from BioTakeAway.

Prices

Prices are quoted in euros and they are based on present market conditions, and are subject to change without notice.

Restriction of sale

BioTakeAway has the right to set minimum order quantity based on geographical location, prices, and volumes. All orders are subject to approval by BioTakeAway and orders shall be honored only upon stock availability.

Cancellation

Any cancellation or reduction by customer in quantity ordered must be made in writing. Orders cannot be cancelled after preparation for shipment. Orders for stock cancelled in whole or in part will be billed a 25% cancellation. Orders may be cancelled by BioTakeAway due to late payments or shortage of stock.
 Returns/ refunds:
According to the EU Distance Selling Regulations, you have the right to return goods if the products are damaged or you simply change your mind. Please return the goods unused and in unopened packaging to us with the invoice within 14 days (legal cancellation period) and we will offer you an exchange or a credit note. NOTE : the product on sale are not eligible for returns. We strongly recommend the use of samples to test the adaptability of our product.

Non-guarantee

Due to variance in raw materials, the products described can vary in sizes, colors or shapes from one case to another or in the same case.

Contingencies

We reserve the right to prorate or cancel any order, in whole or in part, because of: strikes, labor shortages, fire, frost, flood, drought, disease, casualty, errors in count, spoilage, or other circumstances beyond our control.
 

Taxes

Any taxes arising from the purchase, use or resale of the goods, such as sales tax, or any other local tax, are the responsibility of the Buyer.

 Limitation of liability

BioTakeAway maximum liability, whether contractual or for negligence or otherwise, is limited in amount to the amount paid to BioTakeAway for the purchase of the stock under all circumstances and regardless of the nature, cause or extent of the loss.

Health and safety disclaimer

Certain products within our offering have properties that make them potentially unsafe if misused. You must, upon receipt of any product from our read carefully any safety warnings and follow clearly any guidelines on how to use the product. If you are in any doubt about the use of the product, the meaning of any warnings, or whether your intended use of the product is safe, we urge you to contact BioTakeAway for clarification prior to use. BioTakeAway will not be held responsible for any negligent use or misuse of products purchased from BioTakeAway or other resellers. If no instructions are issued and you have a query about how to use the product you are purchasing, we request that you consult BioTakeAway.

Method & Terms of Payment

We accept Visa, MasterCard and Paypal. Credit/Debit card payments made online are secure. Wire Transfers are also accepted. We do not store credit/debit card details.American Express are NOT accepted.

Receiving and acceptance

All shipments should be immediately and carefully unpacked and inspected on arrival and then placed in proper storage. Any problems with the condition or quality or quantity of goods received should be brought to our attention immediately

Claims

Claims for any reason must be made in writing within 5 days after arrival of goods, which period of time is expressly agreed to be reasonable. If Buyer does not give such notice, Buyer agrees to have irrevocably and unconditionally accepted the goods. BioTakeAway furthermore will not consider any claim after the stock has been processed, improperly stored, or otherwise treated, modified or used in any way. Claims for losses while goods are in transit must be filed by the Buyer directly with the carrier.

Severability

In the event that any part of these terms and conditions of sale is held to be illegal or unenforceable in any jurisdiction, the other parts shall nonetheless remain in full force and effect.These terms and conditions of sale may not be changed or amended except by written agreement signed by an officer of BioTakeAway. By acceptance of the stock, the buyer acknowledges that the limitations and disclaimers herein described are the conditions of sale and that they constitute the entire agreement between buyer and seller.
